These Terms of Use (“Terms”) govern your use of powerpepsusa.com (the “Site”) and your purchases from Power P Holdings, LLC, a New Jersey limited liability company doing business as POWERpepsUSA (“POWERpepsUSA”, “we”, “us”, “our”). By using the Site or placing an order, you agree to these Terms, our Privacy Policy, our Research Use Disclaimer and our Shipping & Returns policy.
1. Eligibility
You must be at least 21 years old and able to form a binding contract to use the Site or buy from us. We ship only to addresses in the United States.
2. Research use only
All products are sold strictly for laboratory research use and are not for human or veterinary use. You agree to use products only as described in our Research Use Disclaimer. We may refuse or cancel any order we believe is intended for a prohibited use.
3. Orders and pricing
Prices are listed in U.S. dollars. Placing an order is an offer to buy; we accept it when we ship the order. We may limit quantities, refuse or cancel orders, and correct errors in prices or product information, including after an order is placed. If we cancel an order after receiving payment, we will refund the amount paid.
4. Payment
We currently accept payment by Venmo or Zelle; payment instructions are shown and emailed after you place your order. Orders ship after payment is received in full. Unpaid orders are canceled after 48 hours.
5. Coupons
Coupon codes have no cash value, cannot be combined unless stated, and may be changed or withdrawn at any time.
6. Shipping, risk of loss, returns
Shipping terms and our returns policy, including the process for damaged or incorrect items, are set out in Shipping & Returns. Opened research materials cannot be returned or refunded.
7. Accounts
Guest checkout is available. If you create an account, keep your login details secure; you are responsible for activity under your account.
8. Site content
Site content, including text, graphics and logos, belongs to us or our licensors. You may not copy or reuse it without our permission. Product information is provided for identification and research purposes only and is not medical advice.
9. Prohibited conduct
You agree not to misuse the Site, including by submitting false information, interfering with its operation, attempting unauthorized access, or reselling products for human or animal use.
10. Disclaimer of warranties
Except as expressly stated in writing, products and the Site are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
11. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim relating to the Site or a product is limited to the amount you paid for that product, and we are not liable for indirect, incidental, special or consequential damages.
12. Indemnification
You agree to indemnify and hold us harmless from claims arising from your misuse of products, including any use other than permitted laboratory research, or from your breach of these Terms.
13. Governing law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. You agree that any dispute arising out of or relating to these Terms, the Site or your purchases will be brought exclusively in the state courts located in Bergen County, New Jersey, or the U.S. District Court for the District of New Jersey, and you consent to the personal jurisdiction of those courts.
14. Changes
We may update these Terms from time to time. The version posted on the Site when you place an order applies to that order.
